Membership Agreement

RATES, PAYMENTS and REFUNDS

MEMBERSHIP DURATION AND AUTOMATIC RENEWEL-Membership is in effect for ongoing months from the Membership start date, with automatic renewal for subsequent months, unless cancelled by either Client or EMPOWER BRAZILIAN JIU JITSU, INC with notification within 60 days in advance of the next billing date.

MEMBERSHIP SUSPENSION- If, for any reason, you need to stop training temporarily, you understand that it is your responsibility to complete a membership suspension form and must be received at least 30 days in advance of your next billing cycle. The auto pay freeze request form is available at the front desk.

CANCEL YOUR MEMBERSHIP- A completed membership cancellation form must be received at least 60 days in advance of your next  billing cycle (example: if you are scheduled to be charged February 15th and you want to cancel for the month of February, you must submit a cancellation form to us by December 15th). The cancel request form is available at the front desk.

 MEMBERSHIP PRO-RATIONS- Payments are made at the beginning of the Membership Period. The first month of enrollment will be pro-rated such that subsequent payments are due on the first (1) day or the fifteenth (15) day of the month; depending on your enrollment date.

PRIVATE/SEMI-PRIVATE SESSIONS- If an individual want's additional training with one of the instructors they are able to purchase them for an additional fee.

ADDITIONAL COSTS- Students must purchase their own uniforms and gear including but not limited to GI (top and bottom), belt, rashguard, and Team T-Shirts. NOT INCLUDED with MEMBERSHIP.

REFUNDS- Membership fees and uniform fees are non-refundable.

 Any tuition not received on time will be assessed a $15 penalty fee. Returned checks will be assessed a $25 penalty fee. I understand that it is my responsibility to make sure my payment is received on-time. Should my credit card, bank account, or other form of payment change, I will notify EMPOWER BRAZILIAN JIU JITSU, INC at least 15 days prior to the next billing cycle to avoid any penalties.

EMPOWER BRAZILIAN JIU JITSU, INC reserves the right to alter the days and/or hours of operation, the curriculum and the amount of classes you’re entitled to attend, if deemed necessary. EMPOWER BRAZILIAN JIU JITSU, INC does not guarantee that you will reach a certain level of competence within any specific time frame and that the students obtaining a certain defined level of competence may be either delayed or accelerated due to changes in the curriculum or as deemed necessary. The student and co-signer agree unconditionally to pay the above tuition without regard to attendance made or classes missed, until paid in full.

The undersigned promises to pay membership and all subsequent installments on the same day of each consecutive Month until paid in full. I authorize EMPOWER BRAZILIAN JIU JITSU, INC to deduct from my credit card/bank account reflecting upon the information stated in the payment information.

WAIVER OF LIABILITY

We, the student and guarantor, if applicable, on behalf of ourselves, members of our family, our heirs, executors, administrators and assigns, hereby forever release, discharge and hold harmless, EMPOWER BRAZILIAN JIU JITSU, INC representatives and agents for injury, loss, or damage to my person or property howsoever caused, arising out of or in connection with my taking part in martial arts classes and activities.

Assumption of risk I am aware and understand that, in general, martial arts is an intrinsically dangerous and hazardous activity, and in particular, the instruction, techniques, and methods of Brazilian Jiu Jitsu and self-defense and EMPOWER BRAZILIAN JIU JITSU, INC. I shall be learning and participation in all such activities as a member of EMPOWER BRAZILIAN JIU JITSU, INC. I acknowledge herein that participating in activities contemplated in this document involve an extremely dangerous and hazardous enterprise. I am voluntary and of my own free will submitting this application for membership, becoming a member and/or learning and participating in EMPOWER BRAZILIAN JIU JITSU, INC programs/seminars in full knowledge and understanding of the serious danger and hazards involved. I hereby consent and agree to any physical contacts to me by my instructors, fellow students, or others in the furthermore of training, practice, or demonstration competition. I hereby consent and agree to completely accept alone any liability whatsoever arising out of any activity relating to instruction, demonstration/competition, or practice (on or off premises).

Health Advisory and Physical Condition I hereby understand and acknowledge that the performance, practice, and utilization of the methods of EMPOWER BRAZILIAN JIU JITSU, INC involve extremely strenuous physical activity, and that I have been advised to consult a physician before commencing and undertaking any activity contemplated by this agreement/application. I hereby represent that, to the best of my knowledge, I am in good physical health and condition, sufficient to undertake the activity and practice constituting the methods of EMPOWER BRAZILIAN JIU JITSU, INC. If the condition of my health changes, during the time of existence of this agreement I will promptly advise my instructor or owner of EMPOWER BRAZILIAN JIU JITSU, INC.

Release In Consideration of (a) being accepted as a member of EMPOWER BRAZILIAN JIU JITSU, INC (b) being instructed by EMPOWER BRAZILIAN JIU JITSU, INC, its methods and techniques, (c) being entitled to participate In any and all of the activities conducted or sponsored in whole or by part by EMPOWER BRAZILIAN JIU JITSU, INC, (d) being permitted to use facilities and equipment, whether owned or leased by EMPOWER BRAZILIAN JIU JITSU, INC in connection with the methods, its training, or other related activities. I hereby agree that I, my heirs, distributes, legatees, guardians, conservator, successors in interest and legal representatives will not make claim, or file suit in a court of law before an administrative agency, or attach the property of (a) EMPOWER BRAZILIAN JIU JITSU, INC, its members, instructors, trainers, employees, owners, or agents seeking damages for injure or damage arising out of the use of any equipment or forgoing activity connected to EMPOWER BRAZILIAN JIU JITSU, INC.  Applicant(s) releases EMPOWER BRAZILIAN JIU JITSU, INC from any and all harm, injure or loss suffered by applicant while inside/outside of the confines EMPOWER BRAZILIAN JIU JITSU, INC facility. EMPOWER BRAZILIAN JIU JITSU, INC shall not be responsible for loss, theft or destruction of money, papers, or personal property of applicant.

Severability Should any part of this agreement be held unenforceable or I conflict with any laws pertaining to this agreement, the validity of the remaining parts or provisions of this agreement shall not be affected by such determination. This agreement is a non-assignable. Applicants agree to strictly follow instructions relating to the subject matter to be taught and any rules and regulations by EMPOWER BRAZILIAN JIU JITSU, INC.
